Vietnamese embassy steps in to help 150 workers in Japan claim unpaid wages

In early December, dozens of Vietnamese workers gathered at the headquarters of the Nekuseru employment agency in Chiba prefecture to demand payment for their September and October wages.

• Đầu tháng 12, hàng chục công nhân Việt Nam đã tập trung tại trụ sở của công ty môi giới lao động Nekuseru tại tỉnh Chiba để yêu cầu thanh toán lương cho tháng Chín và tháng Mười.

Upon discovering the incident, Phan Tien Hoang, First Secretary and Head of Labor Management at the Vietnamese Embassy in Japan, traveled to Chiba to work with the Vietnamese workers, representatives of Nekuseru and the company recruiting Vietnamese workers, and authorized agencies from Toyota city in Aichi prefecture.

• Khi phát hiện vụ việc, ông Phan Tiến Hoàng, Bí thư thứ nhất và Trưởng Ban Quản lý Lao động tại Đại sứ quán Việt Nam tại Nhật Bản, đã đến Chiba để làm việc với công nhân Việt Nam, đại diện của Nekuseru và công ty tuyển dụng công nhân Việt Nam, cũng như các cơ quan có thẩm quyền từ thành phố Toyota ở tỉnh Aichi.

Hoang noted that approximately 150 Vietnamese workers are owed wages by Nekuseru, and representatives from the Vietnamese embassy have worked with the Toyota Labor Standards Inspection Office, which is responsible for addressing labor-related issues.

• Ông Hoàng cho biết khoảng 150 công nhân Việt Nam đang bị Nekuseru nợ lương, và đại diện từ Đại sứ quán Việt Nam đã làm việc với Văn phòng Kiểm tra Tiêu chuẩn Lao động Toyota, cơ quan chịu trách nhiệm giải quyết các vấn đề liên quan đến lao động.

According to the response from local authorities, as of the time the embassy representatives worked with Toyota City, the owner of Nekuseru had not declared bankruptcy and was still operating. Therefore, authorities had no legal grounds to address the case. In the event that Nekuseru declares bankruptcy, the prefecture’s administration will freeze the company's bank accounts to partially pay workers' wages first. If the account funds are insufficient, it will activate a government debt payment scheme.

• Theo phản hồi từ chính quyền địa phương, tại thời điểm đại diện đại sứ quán làm việc với thành phố Toyota, chủ sở hữu của Nekuseru chưa tuyên bố phá sản và vẫn đang hoạt động. Do đó, chính quyền không có cơ sở pháp lý để giải quyết vụ việc. Trong trường hợp Nekuseru tuyên bố phá sản, chính quyền tỉnh sẽ đóng băng tài khoản ngân hàng của công ty để trả lương cho công nhân trước. Nếu số tiền trong tài khoản không đủ, sẽ kích hoạt chương trình thanh toán nợ của chính phủ.

The embassy representative guided the Vietnamese workers in submitting applications to Japanese authorities, requesting government-backed wage compensation due to Nekuseru’s prolonged non-payment. Officials from Chiba prefecture formally received these applications. Based on the submitted requests, authorities will require Nekuseru to proceed with debt repayment procedures.

• Đại diện đại sứ quán đã hướng dẫn công nhân Việt Nam nộp đơn lên chính quyền Nhật Bản, yêu cầu bồi thường lương do chính phủ hỗ trợ vì Nekuseru chậm trễ trong việc thanh toán. Các quan chức từ tỉnh Chiba đã chính thức nhận các đơn này. Dựa trên các yêu cầu đã nộp, chính quyền sẽ yêu cầu Nekuseru tiến hành các thủ tục trả nợ.

The Vietnamese workers with owed wages had come to Japan under engineer, technician, and interpreter visas and were directly recruited from Vietnam. These workers were employed by Nekuseru, which then dispatched them to other Japanese companies under labor leasing agreements. The companies hiring workers from Nekuseru did not pay the workers directly but instead transferred their wages to Nekuseru, which was responsible for paying the workers.

• Các công nhân Việt Nam bị nợ lương đã đến Nhật Bản theo diện visa kỹ sư, kỹ thuật viên và phiên dịch viên và được tuyển dụng trực tiếp từ Việt Nam. Những công nhân này đã làm việc cho Nekuseru, sau đó được công ty này điều phối tới các công ty Nhật Bản khác theo hợp đồng cho thuê lao động. Các công ty thuê công nhân từ Nekuseru không trả lương trực tiếp cho công nhân mà chuyển tiền lương cho Nekuseru, công ty chịu trách nhiệm trả lương cho công nhân.

The Labor Management Board has provided rice for the Vietnamese workers to help them overcome the current difficulties and requested Chiba prefecture and Toyota city to implement specific and practical support measures for the Vietnamese workers facing hardship due to unpaid wages.

• Ban Quản lý Lao động đã cung cấp gạo cho công nhân Việt Nam để giúp họ vượt qua khó khăn hiện tại và yêu cầu tỉnh Chiba và thành phố Toyota thực hiện các biện pháp hỗ trợ cụ thể và thiết thực cho công nhân Việt Nam đang gặp khó khăn do chưa được trả lương.
