Man jailed 30 months for abusing democratic freedoms

The man, Truong Huy San, born in 1961, resides in Ho Chi Minh City’s District 3.

According to the indictment of the Supreme People’s Procuracy, between 2015 and 2024, San, gathered information and documents, drafted, and posted numerous articles on his personal Facebook page - Truong Huy San (Osin Huy Duc). Thirteen of these articles allegedly infringed upon State interests and the rights and legitimate interests of organizations and individuals. The posts attracted significant interaction, comments, and shares, leading to a negative impact on national security, and social order and safety. As such, it is neccessary to process the case in accordance with the law.

• Theo cáo trạng của Viện Kiểm sát Nhân dân Tối cao, từ năm 2015 đến năm 2024, San đã thu thập thông tin và tài liệu, soạn thảo và đăng nhiều bài viết trên trang Facebook cá nhân của mình - Trương Huy San (Osin Huy Đức). Mười ba trong số các bài viết này bị cho là xâm phạm lợi ích của Nhà nước và quyền, lợi ích hợp pháp của các tổ chức và cá nhân. Các bài đăng đã thu hút sự tương tác đáng kể, bình luận và chia sẻ, dẫn đến tác động tiêu cực đến an ninh quốc gia, trật tự và an toàn xã hội. Do đó, cần phải xử lý vụ việc theo quy định của pháp luật.

San told the court that he had created, managed and used the Facebook page "Truong Huy San (Osin Huy Duc)" on his own, without sharing administrative rights with anyone else. The posts published on his Facebook were solely his responsibility, and he gathered and assessed the information himself.

• San khai trước tòa rằng ông đã tạo, quản lý và sử dụng trang Facebook "Trương Huy San (Osin Huy Đức)" một mình, không chia sẻ quyền quản trị với bất kỳ ai khác. Các bài viết được đăng trên Facebook của ông hoàn toàn là trách nhiệm của ông, và ông tự mình thu thập và đánh giá thông tin.

The defendant said that when posting the articles, his intention was not to oppose the Party or the State. However, he acknowledged that some of the content in the 13 posts violated the interests of the State and the legitimate rights of several organizations and individuals.

• Bị cáo cho biết khi đăng các bài viết, ý định của ông không phải là chống đối Đảng hoặc Nhà nước. Tuy nhiên, ông thừa nhận rằng một số nội dung trong 13 bài viết đã vi phạm lợi ích của Nhà nước và quyền lợi hợp pháp của một số tổ chức và cá nhân.

San expressed regret for his actions and took responsibility before the authorities, the organizations, and the individuals affected by his posts.

• San bày tỏ sự hối hận về hành động của mình và chịu trách nhiệm trước các cơ quan chức năng, các tổ chức và cá nhân bị ảnh hưởng bởi các bài viết của ông.

As a result, San admitted that his actions violated Article 331 of the Penal Code and agreed with the charges brought against him by the Supreme People's Procuracy for "abusing democratic freedoms to infringe upon the interests of the State, the rights and legitimate interests of organisations and individuals."

• Kết quả là, San thừa nhận rằng hành động của mình vi phạm Điều 331 của Bộ luật Hình sự và đồng ý với các cáo buộc do Viện Kiểm sát Nhân dân Tối cao đưa ra về việc "lạm dụng quyền tự do dân chủ để xâm phạm lợi ích của Nhà nước, quyền và lợi ích hợp pháp của tổ chức, cá nhân."

In his final statement in court, the defendant acknowledged his violation of the law and expressed hope that the court will consider reducing his sentence, allowing him the opportunity to engage in social activities.
